Explaining How The Visa & Arrival Process Works - [About Visa]
- You provide your documents
- You Sign a contract (this is your intent to work for a particular school)
- You (in most cases) complete your medical check and email us the results (1-8 days)
- The school then sends your documnets, medical and contract to the FAO (Foreign Affairs Office) to be approved for a visa (1-4wks)
- Assuming success, the school receives your invitation letter to China and approval for Z-Visa/Resident status upon arrival in China, and mails them to you (3-5 business days)
- Book your flight (We recommend you only book one way, China is a place where you will probably stay longer)
- You take these documents, a visa application form, passport, and new passport photos to your nearest Chinese Embassy to apply for an entry Z-visa (1-4 days processing time)
- Once approved , you can come to China
- Upon arrival, the school will pick you up in the host city, and take you to your accommodation, school, etc
- They will then take your passport and newly co-signed contracts to the FAO again, to verify your arrival and validity as a future resident
- Within 1-2 weeks you will receive your Foreign Experts Certificate/Residents Permit, allowing you to come and go from China as much as you like until the date of expiry

ESL Teachers and Work Visa - [About Visa]
Most ESL teachers with some experience have had to deal with bad teaching jobs. If the English teacher was lucky the job was a simply tutoring or a part time evening job which could be dropped easily, with little hassle. Unfortunately quite often the bad English school is the teachers main employer and visa supplier. When the international school threatens the teachers work visa many teachers panic and back down. This is the wrong thing to do.
Work Visas for Foreign Teachers
Most teachers obtain their work visas through their school; without it they cannot legally teach English or even work in a foreign country. Bad ESL schools will threaten to not renew or even revoke a work visa unless the teacher agrees to their demands.
Often the international school will threaten the teacher with an inability to work for another school, extradition and even jail time due to "mistakes" with the work visa. The teacher will be told if he takes a small cut in pay, teaches more classes, stays with the school for another year or similar demands the school will make sure nothing bad happens.
As long as the foreign teacher is working legally, these are empty threats.
Failure to Renew an English Teachers Work Visa
If the school refuses to renew a work visa, there is a simple solution for teachers. Find a n.ew teaching job As long as the work visa is still valid, foreign teachers can move around the city or country and find a new school. Depending on the country, getting the renewed work visa transferred to the new jobl might take some effort, especially if the old school refuses to fire the teacher. Fortunately most of these problems can be sorted out by the new school or a quick trip to a lawyer to learn the exact work-related laws.
However this does not always work. Sometimes there isn't enough time to renew the work visa, the government needs a specific document from the old school, or the old international school bribed the right government official to punish the ESL teacher. In this case the teacher should simply let the work visa expire and get a tourist visa.
With a tourist visa, teachers can't legally work, but they can look for a new teaching job without having to worry as much about their old school. In most countries transferring the work visa requires a lot of work, but once the visa has expired it ceases to matter. Getting a new work visa through another international school becomes much more streamlined and feasible. This costs more money and time, but with most countries its the best option.
Revoking an ESL Teacher's Work Visa
Unless an international school is well connected and the government is corrupt, a school can't revoke the work visa. The worst they can do is inform the government that the teacher has broken the law in some way. This isn't good, but as long as the teacher is following the law, it can be dealt with by consulting a lawyer. If the school claims an teacher broke the law and the police discover otherwise, the school will be in trouble. So this threat is not often followed.
This is why legally teaching English in a country is the best way to avoid problems.
If the foreign teacher is working illegally, the school has the advantage. While the governments of many countries will turn a blind eye to illegal English teachers, once it is brought to their attention, the police will spring into action.
South Korea is especially notorious for this type of behaviour. Many teachers teach English illegally with the ESL schools' complete support. However if there is a disagreement, the school will be shocked to learn that their teacher lied to them and call the police. This usually ends with the teacher spending time in jail, being banned from working in South Korea and denied reentry into Korea for several years.
Illegal teachers must plan carefully, have emergency money and a back up plan.
Teaching English Legally is the Best Way
As long as a foreign teacher is teaching English legally, an international school cannot threaten his or her work visa in a realistic manner. If the school doesn't renew a work visa, the teacher can find a new school, or get a tourist visa while searching for a new teaching job. If the school threatens to revoke a work visa or turn it over to police, talking to a lawyer or even threatening to do so will often stop the threat cold. It may cost some money, but its better than allowing a school to bully its teachers.

Avoid Teaching English in Shanghai? - [Something you must know]
It seems that most foreigners are only familiar with several big cities in China, like Beijing, Shanghai,
Guangzhou, and focus on jobs in these cities. As a result, there are more applicants and competition there,
which leads to a relatively lower salary because of the much higher living cost than that in other cities.

As a recruiter, my advice is:If you don't have any special reasons to work in big cities, it would be a better choice to work in a relatively
smaller city, where the salary is almost the same as that in big cities but the living cost is much lower, and what's
more, the scenery is usually more beautiful and the local people are more friendly.
It's always understandable that you may be disappointed if you came to China just for money. Working in China
you may not earn much money, but you could experience the special Chinese culture, enrich your experiences and
afford your travel in China with your salary. I personally do think it is indeed a great plan.

After consulting various resources, I finally confirmed the visa policy last week - foreigners don't reside or work in Hong Kong permanently will be required to apply Chinese visa from the Embassy or Consulate-General of Peoples' Republic of China in their resident countries.
Grrrr.... it means if you have entered China with your L visa but would like to work here, you'll then be required to return your native country for the purpose of obtaining and returning with a new Z visa. More often than that, "visa runs" to Hong Kong are no longer acceptable, since the visa notification won't be issued if the employers choose Hong Kong as the application place. As I know, right now only in Beijing you can convert your L visa to Z without leaving China visa through some agencies help.
American Citizens:
1. Tourist Visas: Applicants must provide proof of hotel reservations, and round-trip airfare tickets.
Relative Visitation: proof of relation to said relative (i.e. birth certificate), proof of address for said relative& round trip airfare tickets.
2. Business Visas: Applicants must provide proof of invitation authorized by the appropriate Chinese authorities, proof of hotel
reservations, and round trip airfare tickets.
Non-American Citizens:
In addition to the above-mentioned requirements detailed in items 1-3, those wishing to obtain visas for non-American passports must also provide:
1. Proof that the applicant has visited China before, in the form of a previously obtained and used Chinese visa.
2. An American Green Card, or a valid H1B, H4, F1, F2, L1, or L2 visa good for over 6 months.
In these circumstances, YLingo would like to inform all the available or engaged teachers residing abroad: please manage your new work visa application after receiving those necessary documents from your future employers, unless you've already got one and no need to renew at the present time.
The updated recruiment procedure is supposed to be like this:

Meanwhile, your Foreign Expert Certificate (FEC) belongs to the school and should be returned to them upon departure.
Please make sure that your current employer provides you with the documents needed by the new school before you finish
your contract so as to provide the new school with at least seven working days to extend your current visa. If you are unable
to do this, then you must ask your present employer to extend your current residency permit by one month (this can be done f
or an extra fee).
Because of the new visa policy, if you run out of time, you will then have to return back to your native country and apply for
a new Z visa from the Chinese consulate there. The PSB will no longer convert L visas into residency permits if the former
residency permit has expired.

Job fair for foreigners, Shanghai 2011 - [Activities & Galleries]
9th April (last Saturday), the State Administration of Foreign Experts Affairs (SAFEA) held its annual Job
Fair for Foreigners in April in Shanghai. As one of the exhibitors, we participated in with a very busy day but it
was a good chance to review the foreign recruitment situation, which I personally think will benefit YLingo more
in the coming future.
The job fair was arranged at Swissotel Grand hotel, where located by Jing'an temple. This big sponsor board at
hall showed the the fair is intended to be a platform for international professionals now.

Thanks to our local colleagues outstanding contribution, they did a good job


More than half of the employers with a stand at the fair were schools organized by Chinajob.com, they joined
for meeting or hiring native speaker English teachers. I was not surprised at that, since education and
training industry is still the main field of foreign job fairs.

But I did found some other company stands were there expecting specific experts, especially at areas such
as clean energy and biological medicine. Interested candidants came to ask if we also offer other positions
like banking, fianance or accounting, yes we do, even though YLingo is originally created as a teaching resourcing
institute, quite a lot of teachers in our talent pool are still specialists in their own studies.


No wonder SAFEA mentioned it can be seen by the number of 1200 people turned up and interviewed by
54 companies, the whole exhibition hall was so crowded!


According to the agency’s statistics, there are more than 200,000 expats are currently living and working in
China. However, due to the global recession, an increasing number of foreigners are looking for jobs in China.
Some sectors continue to have a huge demand for foreign talents, such as education, finance and IT, and the
demands are shifting to more professional industries like banking and investment.So the fact is the domestic job
market for foreigners is shrinking, when many Chinese professionals can already speak very good English,
foreigners need more professional qualifications to find their ideal jobs here. It's a clear sigh that English skills
are no longer the edge they used to be for foreigners seeking work.
We talked with more than 50 would-be employees face to face, and new visitors still kept coming near the end
of the fair. With a more diverse range of job needs keeps growing in Shanghai, think next year the fair will attract
more job applicants and company employers.

For employers:
1. bottle water is definitely necessary, or your throat will burn like fire after keep talking for a whole day

2. make a note or put a mark on every single resume, it'll help you to recognize the who the candidate was
3. double check the information form to avoid knowing nothing about visitors illegible handwriting
For job hunters:
1. I would say your resume would be identified easily if it's with a photo... after interviewed so many different
people, ok ok, I admit it was quite difficult to "match" their faces and resume


2. no need to be there too early, but please don't be too late - at the last moment of the fair, most exhibitors will
busy with finish off their work, instead of having a detailed conversation with you
3. Have to say you'll impressed the employers if you speak some good Chinese

How to be a Successful Foreign Teacher in China - [ESL Teaching]
Teaching in China as a foreigner can be exciting and rewarding. What you need are the useful weapons of the
TESOL teacher. The following will provide you some useful weapons.
Preparation
First, get TESOL qualifications. An Internet search will yield hundreds of options available for TESOL
studyfrom an MA in TESOL to a week intensive TEFL course. Courses are available online, through distance
learning, residential overseas programs, or traditional means of study in your country. Which should you choose?
If you already have teaching qualifications or a degree, in some places you won’t need TESOL qualifications to
find employment. However, it’s in your own best interests, and your students’, to study and practice TESOL before
launching your new career.
Before committing to any course, find out how it’s regarded both by TESOL practitioners and potential employers.
Research now can save you problems later. Go to some online ESL employment sites to check what qualifications
employers require. See if there is any advice by teachers about good or bad courses. Talk with former students in
the course. After you’ve completed your qualifications and are ready to find a job, don’t rush into a job commitment.
Visit Internet sites to discover the idiosyncrasies of different countries and institutions.
Organization
Once you’ve thought over the possibilities, make sure your resume is current and line up some references.
A valid email address and telephone number are necessary so potential employers can contact you.
To avoid confusion, leave a summary of the positions you applied for by the phone with a pen for note-jotting.
Don’t stop researching just because you’ve sent out a heap of job applications.
Keep visiting the ESL sites, browsing current jobs, reading, and making posts.
Ask questions about your potential employers and try to establish a network with other teachers, particularly those
who live where you would like to go.
Read as much as you can about places you want to visit and the people you will meet.
Make sure you have the email address of an employee at the school whose job is to answer your questions.
Ask for the email address of a TESOL teacher already working there who can answer different questions,
such as ones about living and working conditions.
Do an Internet search on the school and town. Invest your time and energy now to avoid possible problems later.
Flexibility
Good preparation and organization can manage about 90 percent of the details of your job.
Flexibility is needed for the remaining 10 percent. There will be surprises.
Being flexible means you continue until you find a compromise or solution.
Perhaps you contact your network, asking for ideas.
Make an appointment to see your principal with a bilingual staff member.
Ask colleagues about a local solution to your problem. If all else fails, extricate yourself from an impossible
situation gracefully.

Shanghai to make social insurance available to expatriate workers - [Something you must know]
Foreigners in China are largely denied in many cities to the right to social insurance coverage when working
in China. Shanghai is also on that list of cities. However, with the mounting demand for national treatment by
foreign employees in respect of social insurances, Shanghai has recently stepped up a regulation amid that
demand on October 10, 2009, namely, Notice of Several Issues on Foreign Employees in Shanghai
Participating in Social Insurance (the “Notice”) Foreign employees in Notice shall include overseas Chinese
citizens who have been granted the permanent residence status and Taiwan, Hong Kong and Macau residents.
The main contents are:
(1)The social insurances available to foreign employees in the Notice are basic pension insurance, basic medical
insurance and work injury insurance. To be eligible for such benefits, employees shall obtain the relevant work
permit as required by law and regulations. We note that the Notice requires that such benefits should be written
in the relevant employment contract, but however, it remains unclear what if the employment contract is silent on
that.We advise that foreign employees shall insist on inserting related clauses addressing social insurances in the
employment contracts upon entry thereof.
(2)After participating in social insurances, foreigners, who reach the retirement ages 60 years old for man, and
55 years old for women), may apply to receive benefits from pension fund in accordance with laws and regulations.
(3)Foreign employees who fall ill during participation in social insurance are entitled to benefits from the basic
medical insurance. However, medical costs incurred abroad shall not be covered by the basic medical insurance.
(4)Foreign employees participating in social insurance may enjoy benefits from work injury insurance if hurt during
work or contracted occupational diseases.
In the event that foreign employees terminate their employment with employers prior to reaching their respective
retirement ages, the balance in their basic pension insurance and medical insurance accounts will be paid in a lump
sum upon settlement.

OK as everybody knows, we've just made our Chinese website brand new last week, it's the time to create a well-designed English one face to overseas teachers and new expats. Our new IT manager, Jhon will be mainly responsible for the project, and I was told that he's all ready for that
The good news was before the Tomb Cleaning Festival, I finally received his visa notification letter from Shanghai Municipal Commission of Commerce!
Please don't feel confused about that never seen paper, company's foreign staff recruitment requires different documents to go through different procedures. If you're hired as an ESL teacher, you'll have to apply for the foreign expat certificate; however, employed as a foreign crew will be issued to submit an alien employment license instead.


When I asked for the special express service to apply Jhon's visa notification, I was really in a hurry. Because of the public holiday will last for 3 days, and if I wanted to deliver everything to Jhon before the holiday (he's in New Jersey waiting for the documents to get his work visa), time would be so pressing. Had to run to the commerce office to explain, the officer over there was quite nice, after listening and checking he approved then even noticed the date on the employment license - "well OK, your company has got that license early!" Yeah, that was true, we got it more than 1 month ago, haha! Think Jhon can prepare for his visa application today, UPS delivery was pretty fast, and it only took 3 days on the way. Again, let's welcome Jhon to the People's Republic of China!!

FAQ: visa - [About Visa]
Working at YLingo, one of the importants parts of my job is making our teachers know more about their visa, especially when they have problems. This FAQ is a short list of answers to some highly asked questions about work visa, I'll try to add more next few days of this week.
The official name of work visa should be called as "employment visa" or "Z visa", just sometimes people are lazy
or seems "work visa" can be much easier to be remembered. Here's the list -Q: Do I have to get B.A. degree to apply Z visa to teach in Shanghai?
A: In most cases, yes. B.A. degree is a necessary condition of both foreign expert certificate and work permit. In some other cities, the visa policy might be a little bit flexible but still on the basis of your teaching experience - if you have taught English for a longer time, or the local schools need you to fill the position urgently, a college diploma or associate degree is acceptable.
Q: Do I need a release letter or a recommendation letter?
A: The release letter, yes, and I have to remind that release letters are ONLY given to those who finished the whole year contract. A recommendation letter is optional, but it'll benefit you if you are required to provide.
Q: Can I get a work visa in my home country?
A: Yes, but you have to make sure you are employed before come to China. Your employer here (usually a school or a company) will apply for work permit and work visa notification with the mateirals you provided (copy of passport, certificates, CV, photoes, etc) then send the original permit and notification to you. With those 2 documents you may apply for a temporary work visa at the embassy of China in where you live, later the temporary work visa will be changed to an one year official one. However, only few schools and companies can do that, the reasons are: 1) they must have the qualification to employ foreign teachers; 2) their registered fund must be over 500, 000 CNY; 3) they will also take a lot risk if something unexpected happened. That's why most of teachers arrived in China with their tourist visa then tried to get a work visa with employment.
Q: If my school working unit has changed, how to go through the formalities?
A: If your school has changed, you must go through the modification formalities within 10 days after
the change happens. First, modify Foreigner Employment Permit or Expert Certificate; then bring relevant
documents to Bureau of Exit-entry Administration to modify the working unit of the Residence Permit.
Q: If my in Shanghai has changed, how to go through the formalities ?
A : Please go to the police station of the new residential place or hotel to apply and get a new, later bringrelevant documents to Bureau of Exit-entry Administration to modify the address of the Residence Permit.

Comments for some language training centers and schools in Shanghai - [Something you must know]
When I was trying to find some feedback of those well-known English traing centers or schools, some information just emerged. "China School Black List, China School Green List", looks interesting uh? Let's have a look:

I clear almost 9,000 rmb a month and my contract is 30 ach (40 mins each) any more has to be mutually agreed and is paid overtime.
Half my flight money has been paid and the rest will be at the end of my contract.
Accomodation is satisfactory without being luxurious!
I average about 27 ach a week and don¡ät have to come in when not working.*Gold *Apple Bilingual School
My experience at Shanghai Gold Apple Bilingual School was good at times and bad at others. The pay was relatively low yet they always pay on time. There was a travel bonus which was nice and they paid for my round trip ticket from the U.S. They paid for travel visas and work visas. Accomodations and meals were free. Accomodations were not fabulous in terms of a kitchen but we did have heat and AC. The children were good and other teachers were extremely kind. "The Chinese way" is something I never learned to deal with and ultimately made me decide to leave after one year. Promises by the school for Chinese lessons were not honored. I only had to teach 18 classes a week with most of them 40 minutes and a few 30 minutes. Bring your own teaching materials!!!!!!

You will work long hours for little personal reward or recognition. You MUST work a nine hour day. They have a questionable evaluation system and even more questionable curriculum.
The people in charge of you know nothing about ESL teaching and do not really care if students are learning or not as long as the wheels keep turning.
The rules and systems and policies, such as they are, will change on a daily basis. Your contract is worthless.If you are sick, you must teach the classes you missed upon your return.
Oh yeah, each class is four hours long. Look before you leap man or the water may just be too deep.------------------------
THE GOOD
They pay on time. Every time. You get a legal work visa and all other necessary paperwork. Your colleagues are generally wonderful.The students are sweet (if somewhat unenthusiastic about English)
THE BAD
This is not an English school. They use the HEADWAY text books. I will say no more.
The Singaporean entrepreneurs who pride themselves on running this pseudo educational institution care ONLY about money.
You must work 45 hours each week.Shanghai *Normal *University, *English *First Shanghai (E*F Shanghai)
Foreign teachers at Shanghai Normal University--even relative oldtimers--were given only one-semester contracts this past September. The reason now seems to have emerged: the school on Guilin Lu in south Shanghai has contracted with corporate English First to run its one-year mandatory oral English course for third-year students. It appears that English First not only will supply the curriculum and supervision but also will have an HR function in determining what teachers will be rehired for the spring semester . . . And, of course, who won¡ät be rehired.
*CHEERY ENGLISH
The company likes to tell "white" lies and will bend the contract rules. They also made me work extra hours, more than stated in my contract, and I was NEVER paid for these extra hours!
They are not legally licensed to hire foreigners, so instead of getting us our Z visas like they are supposed to, they instead make us pay extra money for other documents so they can just extend the visa. They wont and they cant get teachers a foreign expert certificate because they are not a legal company.
Not worth the time, PLEASE, when working in China, make sure the company or school has a OVERSEAS EMPLOYMENT LICENSE.To be honest, I think all the above messege gave the realistic reflection to the English training schools in Shanghai, I might can tell more if time allows ( joking
). Well, the fact is some schools are not professional enough, foreign teacher recruitment and management is an ART, it's so important that every little thing will change the relationship between both side, especially when we have different cultural background. We gonna be more careful to choose qualified work places for our teachers, since a legal company/school and a friendly work enviornment are always the most important things. The last but not the least, communication is very, very necessary. -

Get to know work usage - [Something you must know]
The normal working week in China is Monday to Friday. Normal working hours are from 8 a.m. to 5 p.m. with a one-hour lunch break. Chinese employees work 8 hours per day, to a maximum of 44 hours per week, with a minimum of one day off per week
China has three major annual holidays:
- National Day, on October 1
- Chinese New Year (Spring Festival), late January to mid February
- Labour Day (May Day), May 1
These aren't one-day holidays: workers get at least a week or two off for Chinese New Year and one week is quite common for both National Day and Labour Day. Students generally get at least four weeks off at Spring Festival and a 9-day (two weekends framing a work week) break for the other two holidays.
The Contract
When accepting an offer of a job in China, you should receive a formal contract from your employer, setting out the conditions of employment, salary to be paid and the benefits that the employee can expect to receive in addition to his or her salary, such as contribution towards accommodation, car or childrens' education. The contract of employment should also set out the conditions for termination of the contract by either party (the employer or the employee). Contracts may have a fixed end date, or may be left open ended. If the end date is specified, the contract can be renewed upon expiry with the agreement of both parties.
The contract will be issued in both English and Chinese. In the event of an employment dispute, the Chinese contract of employment will be used as the point of reference.

How to calculate your income tax - [Something you must know]
Personal income tax in China is paid on:
- Income from wages and salaries
- Self employment income
- Income from contracted or leased businesses
- Income from payments for personal services
- Income from royalties

China has nine income tax bands. These are:

Which one is better, TEFL, TESOL or TESL? - [Teaching Certificates]
Last week I was asked about the teaching certificates, TEFL, TESOL, TESL and even CLETA, some
potential foreign teachers wanted to know which one is better for getting a good teaching job in Shanghai.
In fact, they are not different courses but just different acronyms for teaching english to non-native speakers.
TEFL - Teaching English as a Foreign Language, this term refers to teaching English in countries such as
Canada, the US, Australia, etc., where English is the common everyday language in the community.
TESOL - Teaching English to Speakers of Other Languages, this is a newer, umbrella term that encompasses both
English and non-English speaking countries.
TESL - Teaching English as a Second Language, this term to teaching English in countries such as Korea,
Spain, Brazil, etc., where English is not the common everyday language in the community.
In other words, it doesn't matter which acronym is used (and they are often used interchangeably), it is the course that matters. As Flash has said CELTA is probably the most highly regarded TEFL/TESOL certificate, (it's awarded by Cambridge ESOL) and good even if you aren't going to teach adulst specifically.
I know someone is really interested in doing teaching job but might think "why bother, I don't need it, why waste the money"; however, I have to say getting certified not only educates you in course planning and classroom management, it also shows your delication to the industry and provides greater working opportunities.
In details, benefits of having certificates include:
- higher starting salary
- prepares you for the experience of teaching
- prepared you to identify and use teachables
- teaches you how to prepare for units and yearly plans
- teaches you how to lesson plan and have clear teaching objective
- teaches you class management
- class discipline techniques
- teaches you English - most native English speakers are not familiar enough with proper grammar - re-educate yourself... I would guess that more than 80% of all first time ESL teachers without certification have no idea what a compound adjective is or a past infinitive. Can you give me a definition without really having to think about it or without looking it up on the Internet?
Furthermore, nowadays the school administrators are more particular about the qualifications of the individuals they hire, and the teaching certificates are necessary when the school apply for the "foreign expert certficate" for you. There's a currently work visa policy of English teachers: you can only work legally with your foreign expert certficate, work permit, work visa and resident permit. So, I'm sure with the teaching certificates, you be a more attractive candidate to employers, but your skills, knowledge and teaching experience will make you more comfortable, confident and effective as a teacher.

Chapter l General Provisions
Article 1These Rules are formulated in accordance with the provisions of the relevant laws and decrees for
the purpose of strengthening the admiministration of employment of foreigners in China.
Article 2The term "foreigners"in these Rules refers to the persons,who under the Nationality Law ont1e People's Republic of China, do not have Chinese nationality.
The term "employment of foreigners in China" in these Rules refers to acts of foreigners without
permanent residence status to engage in remunerative work within Chinese territory in accordance with it laws.
Article 3These Rules shall apply to employed foreigners within Chinese territory and their employers. These Rules shall
not apply t。foreigners who enjoy diplomatic privileges and immunities employed by foreign embassies or
consulates,or the offices of the United Nations and other international organizations in China.
Article 4The labour administrative authorities of the people's govemmer1t of the provinces,autonomous regions and municipalities directly under the Central Government and those at the prefecture and
city level with their authorization are responsible for the administration of employment of foreigners China.
Chapter II Employment License
Article 5The employer shall apply for the employment permission if it intends to employ foreigners and may do so after
obtaining approval and The People's Republic of China Employment License for Foreigners(hereinafter referred to as the "Employment License").
Article 6The post to be filled by the foreigner recruited by the employer shall be the post of special need,a post that cannot be filled by any domestic candidates for the time being but violates no government regulations
No employer shall employ foreigners to engage in commercialized entertaining performance, except for the persons qualified under Article 9(3)of these Rules.
Article 7Any foreigners seeking employment in China shall meet the following conditions:
(1)18 years of age or older and in good health
(2)with professional skills and job experience required for the work of intended employment;
(3)with no criminal record;
(4)a clearly-defined employer;
(5)with valid passport other international travel document in lieu of the passport(hereinafter referred to as the "Travel Document").
Article 8Foreigners seeking employment in China shall hold the Employment Visas for thew entry(In case of agreement for mutual exemption of visas,the agreement shall prevail.), and may wok within Chinese territory only after they obtain the Employment
Permit for Foreigner(hereinafter referred to as the"Employment Permit")and the foreigner residence certificate Foreigners who have not been issued residence certificate (i.e. holders
of F,L,C or G types visas), and those who are under study or interim programs in China and the families of holders of Employment Visas
shall not work in China.In special cases employment may be allowed when the foreigner changes his status at the public security organs with the
Employment License secured by his employer in accordance with the clearance procedures1under these Rules
foreigners changes his status at the public security organs with the Employment License and receives his
Employment permit and residence certificate. The employment in China of the spouses of the Personnel of foreign ernbassies,
representative offices of the United Nations System and other international organization in China shall follow the Provisions
of Ministry of Foreign Affairs of the People's Republic of China Concerning the Employment of the Spouses of the
Personnel of Foreign EmbassiesConsulates and the Representative Offices of the United Nations System in China and
be handled in accordance with the clearance procedures provided for in the second paragraph of this article.
The Employment License & the Employment Permit shall be designed and prepared exclusively by the Ministry of Labour.
Article 9Foreigners may be exempted from the Employment License and Employment permit when they meet any of
the following conditions:
fprofessional technical and managerial personnel employed directly by the Chinese government or those with
senior technical titles or credentials of special skills recognized by their home or international technical authorities or
professional associations to be employed by Chinese government organs and institutions and foreigners holding Foreign
Expert Certificate issued by China's Bureau of Foreign Expert Affairs;
foreign workers with special skills who wok in offshore petroleum operations without the need to go ashore for
employment and hold"Work Permit for Foreign Personnel Engaged in the Offshore petroleum Operations in the people's
Republic of China";foreigners who conduct commercialized entertaining performance with the approval of the Ministry of Culture and hold
"permit for Temporary Commercialized Performance".
Article 10Foreigners may be exempted from the Employment License and may apply directly for the Employment Permit by
presenting their Employment Visas and relevant papers after their entry entry when they meet any of the following
conditions:
foreigners employed in China under agreements or accords entered into by the Chinese government with foreign governments or international organizations for the implementation of Sino-foreign projects of cooperation and exchange;
chief representatives and representatives of the permanent offices of foreign enterprises in China.
Chapter III Application and Approval
Article 11The employer When intending to employ a foreigner,stall fill out the Application Form for the Employment
of Foreigners(hereinafter referred to as the"Application Form")and submit it to its competent trade authorities at the same level as the labour administrative authorities together
with the following documentations:
(1)the curriculum vitae of the foreigner to be employed;
(2)the letter of intention for employment;
(3)the report of reasons for employment;
(4)the credentials of the foreigner required for the performance of the job;
(5)the health certificate of the foreigner to be employed;
(6other documents required by regulations. The competent trade authorities shall examine and approve the
application in accordance with Arides 6 and 7 of these Rules and relevant laws and decrees.
Article 12After the approval by the competent trade authorities,the employer shall take the Application Form to the labour administrative authorities of the province,autonomous region or municipality directly under the Central Government or the labour administrative authorities
at the prefecture and city level where the said employer is located for examiexamination and clearance.The labour
administration authorities described above shall designate a special body(hereinafter referred to as the"Certificate Office") to take up the responsibility of issuing the Employment License.
The Certificate Office should take into consideration of the opinions of the competent trade authorities and the
demand and supply of labour market,and issue the Employment License to the employer after examination and clearance.
Article 13
Employers at the Central level or those without the competent trade authorities may submit their application directly
to the Certificate Office of the labour administrative authorities for the Employment Permit. The examination and
approval by the competent trade authorities is not required for foreign-funded enterprises to employ foreigners,and such enterprises may submit their applications directly to the Certificate Office of the labour administrative
authorities for the Employment License,bringing with them the contract, articles of association, certificate of approval, business license and the
documentation referred to in Article 11of these Rules.
Article 14Employers with permission to employ foreigners shall not send the Employment License nor the letter of visa
notification directly to he foreigners to be employed1and they must be sent by the authorized unit.
Article 15 Foreigner with permission to work in China should apply for Employment Visas at the Chinese embassies,consulates and visa offices, bringing with them the Employment License issued by the Ministry of Labour,the letter or telex of visa notification sent by the authorized unit and the valid passport or Travel Document.Personnel referred to in Article 9
of these Rules should apply for the Employment Visas by presenting their letter or telex of visa notification
by authorized unit;personnel referred to in Article 9
should apply for the Employment Visas by presenting their letter or telex of visa notification issued by the China
National Offshore Oil Corporation; personnel referred to in Article9should apply for the Employment Visas by
presenting their letter of telex of visa notification issued by the foreign affairs, office under the people's government
of privinces, autonomous regions or municipalities directly under the Central Government and the relevant documents
of approval of the Ministry of Culture (addressed to the Chinese embassies,consulates or visa offices). Personnel referred to in Article 10(1)of these Rules should apply for the Employment Visas by presenting their letter or telex of visa notification by
authorized unit and the documentation on projects of cooperation and exchange;personnel referred to in Article 10should apply for the Employment Visas by presenting their letter or telex of
visa notification by the authorized unit and the registration certification issued by the administrative authorities of
industry and commerce
Article 16The employer should,within fifteen days after the entry of the employed foreigner take to the original Certificate Office the Employment
License the labour contract with the said foreigner and his passport or Travel Document to receive his Employment
Permit while filling out the Foreigner Employment Registration Form. The Employment Permit shall be effective only
within the area specified by the Certificate Office.
Article 17Foreigners who received their Employment Permit should,within thirty days after their entry,apply for the residence certificate with the public security organs bringing with them their Employment Permit.
The term of validity of the residence certificate may be determined in accordance with the term of validity of
the Employment Permit.
Chapter IV Labour Adn1inistration
Article 18The employer and its foreign employee should,in accordance with law,conclude a labour contract,the term of which shall not exceed five years Such contract may be renewed upon expiration after the completion
of clearance process in accordance with.
Article 19of these Rules. Article 19 The Employment Permit of the employed foreigner shall cease to be effective upon
the expiration of the term of the labour contract between the foreigner and his employer.If renewal is required,the employer should,within thirty days prior to the expiration of the contract,submit an application to the labour administrative authorities for the extension of term of employment,and after approval is obtained,proceed to go through formalities for the extension of the Employment Permit.
Article 20The foreign employee should,within ten days after obtaining the approval for extension of his term of employment in china or t he change of
his employment location or his employer, go through formalities for the extension or change d his residence
certificate at the local public security organs.
Article 21After the termination of the labour contract between the foreign employee and his employer,the employer should promptly report it to the labour and public security authorities,return the Employment Permit and the residence certificate of the said foreigner,and go through formalities for his exit from China
Article 22The wage paid to the foreign employee by the employer shall not be lower than the minimum wage in the locality.
Article 23
The working hours,rest and vacation,work safety and hygiene as well as the social security of the foreign employees in China shall follow the relevant
provisions of the state.

A Brief Introduction of Chinese Visa and the Procedure for Visa Application - [About Visa]
Chinese visa is a permit issued to a foreigner by the Chinese visa authorities for entry into, exit from or
transit through the Chinese territory. The Chinese visa authorities may issue a diplomatic, courtesy,
service or ordinary visa to a foreigner according to his identity, purpose of visit to China and passport type.
Hereunder is an introduction to the ordinary visa and its application procedure:
The ordinary visas consist of eight sub-categories,
which are marked with Chinese phonetic letters (D, Z, X, F, L, G, C, J-1 and J-2 respectively).
Visa D: issued to aliens who are to reside permanently in China. A permanent residence confirmation
form shall be required for the application of Visa D. The applicant shall apply to obtain this form himself
or through his designated relatives in China from the exit-and-entry
departmentof the public security bureau in the city or county where he applies to reside.
Visa Z: Issued to aliens who are to take up posts or employment in China, and to their accompanying
family members. To apply for a Visa Z, an Employment License of the People's Republic of China for
Foreigners (which could be obtained by the employer in China from the provincial or municipal labor
authorities) and a visa notification letter/telegram issued by an authorized organization or company
are required.
Visa X: Issued to aliens who come to China for study, advanced studies or job-
training for a period of six months or more. To apply for a Visa X, certificates from the receiving
unit and the competent authority concerned are required, i.e., Application Form for Overseas Students
to China (JW201 Form or JW202 Form), Admission Notice and Physical Examination Record
for Foreigners.
Visa F: Issued to an applicant who is invited to China on a visit, on a study or lecture, business tour,
for scientific-technological and cultural exchanges, for short-term refresher course or for job
training, for a period of no more than six months. To apply for a Visa F, the invitation letter from the
inviting unit or the visa notification letter/telegram from the authorized unit is required.
Visa L: Issued to aliens who come to China for sightseeing, visiting relatives or other private purposes.
For a tourist applicant, in principle he shall evidence his financial capability of covering the traveling
expenses in China, and when necessary, provide the air, train or ship tickets to the heading country/region
after leaving China. For the applicants who come to China to visit relatives, some are required to provide
invitation letters from their relatives in China.
Visa G: Issued to aliens who transit through China. The applicants are required to show valid visas and
on-going tickets to the heading countries/regions.
Visa C: Issued to train attendants, air crewmembers and seamen operating international services,
and to their accompanying family members. To apply for a visa C, relevant documents are required
to be provided in accordance with bilateral agreements or regulations of the Chinese side.
Visa J-1: Issued to foreign resident correspondents in China.
Visa J-2: Issued to foreign correspondents who make short trip to China on reporting tasks.
The applicants for J-1 and J-2 visas are required to provide a certificate issued by the competent
Chinese authorities.
In addition to providing the above-mentioned documents, an applicant is also required to answer relevant questions and go through the
following formalities (with the exception of those stipulated otherwise by agreements):
Providing valid passport or a travel document in lieu of the passport
Filling out a visa application form, and providing a recent 2-inch, bareheaded and full-faced passport photo.

Work (Z) Visa Application - [About Visa]
ESL teachers, many are puzzled at their work visa issues.
Actually "work visa" should be formally called "employment visa", also called Z visa.
The Z visa is the only legal way to constantly work in China, be it for a Chinese or a foreign company.
The Z visa constitutes the basis for the residence permit, it is issued for only a short period of time which will
allow you to change it into a residence permit.
Process of Getting Z visa* :
The employer is responsible for applying for a work permit for you and
will need to hand in a bunch of documents.
Those are:
a) Counterpart of business license of the enterprise (original and one copy)
b) Approval Certificate (copy)
c) "Application for Recruiting Foreign Worker in China" (form provided by agency/employer)
d) The letter of intention for employment (provided by agency / employer)
e) Board resolution and articles of association required for the position of managing director(with company chop)
f) Your personal resume (Chinese Version), original and one translated copy of each diploma and certificate
of vocational qualification
(Please note that the authorities will take these qualifications as proof you are sufficiently skilled to fill a position
that cannot be filled by a Chinese employee. In practice, this means they will check if you are above the age of
25 and below the age of 60, have a relevant diploma of at least bachelor level, a minimum of two years of
relevant work experience and so on. They can be more or less strict on these points but applications will
usually be tough if your degree is less than two years away. For foreign language teachers or senior
technical staff, companies can apply for a "Foreign Expert Certificate" to circumnavigate the 60 years old /
university diploma restriction.)
g) Passport
h) Physical examination record (Health Check)
i) One photocopy
j) Reference letter from your enterprise. Please provide one official letter paper with company chop.

k) Working permit request form (provided by agency / employer)
l) Since June 2008, some Chinese provinces have started requesting criminal record certificates from
at least some work permit applicants.
To apply for a Z visa abroad, you will need to provide:
a) the original work permit
b) a copy of your health check, but still need to show the original
c) the visa application form with a picture
d) your passport
Apply for a Alien Employment Permit in China with:
a) your work permit
b) your passport
c) the original of yourphysical examination record (Health Check)
d) two pictures
e) a copy of your employment contract
f)the employment registration of foreign workers in China.
You and your employer can proceed to switching your Z visa to a residence permit with:
a) Your Work Permit
b) The counterpart of the business license of the enterprise (original and one copy)
c) The temporary residence certificate your got when you first registered with your local police station
d) Your passport
e) one picture
f) the visa andresidence permit application form.
What you'll finally get is a red "cancelled" stamp over your Z visa and a brand new sticker in your
passport saying "residence permit for foreigner". The residence permit is usually valid for one year
and allow you to travel freely from and to China (multiple entries) during its validity.

21 productive ideas for the private teacher - [ESL Teaching]
The following ideas are offered as suggestions to help make you a more effective teacher. By employing these ideas, you can maximize the benefits that your students receive from each lesson with you.
1. Plan Ahead: Have an overall plan as to how you're going to move the student along. It doesn't have to be set in concrete, but it does help you avoid wandering aimlessly from week to week.
2. Establish Groundrules: You need to establish a basic understanding between you and the student early in the game. Basic groundrules can include regular practice requirements, fees, payment methods, attitude, etc. It's a good idea to type your groundrules and give a copy to every new student at the first lesson.
3. Teach Practice Skills: Practice skills are very similar to study skills. Once you have them, everything comes more easily. A regular practice schedule needs to be set up with each student. Explain that you won't be around to enforce it, and it's his/her responsibility to carry it out. Parents can be helpful in keeping the student honest. Good practice skills, when learned and used, can make all the difference in the world.
4. Keep Your Studio Clean and Up-To-Date: A clean environment promotes better learning. It also helps your students feel as though they're in an organized, important place, and this is vital. Have enough of all the proper equipment and teaching aids readily available. It goes without saying that all studio equipment should always be properly maintained. It's an investment that can pay for itself many times over.
5. Don't Miss Lessons: If for some unavoidable reason you have to miss a lesson, give the student advance notice. (You obviously have the right to expect the same courtesy from your students.) Set up an alternate lesson date immediately, at the student's convenience, not yours.
6. Teach All Styles: It's important for today's drummer to be able to play in a variety of styles. Your students don't have to be masters of every style, but they should be able to hold their own in as many musical situations as possible.
7. Reinforce: Don't forget old material. Students have a tendency to forget the basics when they're not reinforced regularly. Don't allow that to happen. Regular reinforcement will keep both you and your students on your toes.
8. Tailor Exercises to Individual Interests: Although it's extremely important to teach a variety of styles, many students will lose interest if what they're learning is not applicable to their current musical interests. Whenever possible, try to use examples from familiar music to demonstrate an important point.
9. Teach with Conviction: It's important to believe in what you're teaching. If you only have a half-hearted belief in what you're doing, it will come across as half-hearted to your students.
10. Point Out Improvements: We all have a natural tendency to stress areas that need improvement, ignoring the improvement itself. You may be the only gauge your students have on their progress. A steady stream of "this needs work" can be disheartening. Of course, this doesn't mean praising when performance isn't worthy of it, but in most lessons, you should be able to point out some area(s) where the student is performing well. Conversely, be aware that approval used sparingly is more effective than constant praise.
11. Don't Fake It: If you don't know the answer to a question, admit it. Feeding a student false information to save face is never a good idea. Once you've admitted you don't know, do your best to find the answer. If you find you're constantly being asked questions you can't answer, take it as a hint. You either need to do more work on the subject, or refer the student to another teacher.
12. Use Surprise: Periodically, ask for something unexpected. This not only keeps your student's attention up, but it also helps to combat monotony. Having a routine is good, but going through the same material in the exact same manner week after week can get boring -- and who wants to go to a boring lesson?
13. Communicate with Parents: This is particularly important if the parents are paying for the lessons. It's common courtesy to keep them abreast of the student's progress. You can also recruit them to help enforce the practice schedule you've set up with the student.
14. Promote Competition: Try to get students involved in competitive situations -- things such as all-state tryouts or local band auditions. This is not to suggest entering students into competitions they're not ready for. Defeat doesn't always build character. But a well-timed competition can help keep a student motivated.
15. Promote Playing: Get your students into some type of musical situation outside of lessons whenever you feel they're ready. Remember, we are trying to create musicians. It's vital for every developing musician to interact with others. There is no substitute for real musical experience.
16. Help Students with Equipment Selection: As a teacher, you'll be expected to know more about the instrument than just how to play and teach it. Students will usually expect you to guide them in their choice of new or additional equipment.
17. Be Aware of Differences in Abilities and Goals: Not all students have equal abilities or expectations. This doesn't mean you shouldn't push a student to his/her full potential. But realize that not every student wants to be a professional. Some may be pursuing drumming for totally different reasons, and it's counterproductive to scare them away with obscure techniques. Also, everyone learns at a different pace. Some students will always be behind the point where you'd like them to be. If a student is not progressing at a satisfactory pace, try to determine the reason. If you can help, by all means do so. If not, accept the fact that things may not always go exactly as planned.
18. Be Willing to Bend: Keep in mind that every student is different, and different students may require different teaching approaches. You should be willing to change your approach if you want to be effective. The only alternative is to only accept a certain type of student -- a choice most of us cannot afford to make.
19. Have Reasons: Be able to explain why you want things done in certain ways. Students often can't see the total picture, or the reasoning behind it. "Because I said so" is not an acceptable answer.
20. Be Patient: This is the golden rule. A highly pressured student won't work as efficiently as one who is comfortable with you. A relaxed student is always more receptive to learning than one who is uptight as a result of an impatient teacher.
21. Stay in Fifth Gear: Teaching requires considerable energy. Be prepared to give 110% for the entire lesson -- every lesson. This includes going into the lesson in a good mood, with a clear head, and with a positive attitude. Always keep in mind that you might be helping to mold the talents of the world's next great drummer! -

Before you start applying for jobs and going to interviews, take a few moments to think about your personality. It may even help to take a personality test.
